Les recherches présentées ici ont en commun de se situer à divers points de contact du logement et du politique. On ne saurait s'en étonner, tant cette « marchandise impossible », selon l'indémodable expression de Christian Topalov, est indissolublement liée à l'action publique et au politique. Bien de première nécessité, le logement fait l'objet, depuis la fin du XIXe siècle, d'une intervention publique visant à corriger les déséquilibres du marché. Devenu le premier poste des dépenses des ménages, l'élément le plus important de leur patrimoine, mais aussi l'un des principaux marqueurs des inégalités sociales, le logement constitue un enjeu incontournable pour les politiques publiques, régulièrement réactualisées car la situation du logement est, de façon récurrente, décrite sous l'angle de la « crise ». Parallèlement, l'action publique s'est recomposée. Le passage progressif de l'Etat fordiste, planificateur et producteur, à l'Etat régulateur et incitatif, s'accompagne d'un changement d'échelle au profit des collectivités locales. La tension entre la présence et l'absence du politique se décline différemment dans les contributions, en fonction de la place respective de la transformation du bâti et des populations, mais aussi selon la façon dont ces dernières sont envisagées, dépendantes de l'action publique ou actrices dans leur rapport avec elle. Les chapitres du présent ouvrage reprennent ces différentes façons d'envisager le rapport du logement et du politique.

Publié chaque année depuis 1996, le DAUH est la mémoire du droit de l'aménagement, de l'urbanisme et de l'habitat. Il constitue le seul inventaire annuel commenté de toutes les évolutions juridiques, ce qui en fait un recueil incontournable pour la connaissance de la matière. Cette 17e édition, à l'instar des précédentes, comporte trois parties. La première partie présente des études, signées par des spécialistes reconnus, de sujets d'actualité tels que les apports récents de la jurisprudence de la CJUE au droit de l'urbanisme français, les questions prioritaires de constitutionnalité (QPC) en matière d'expropriation, l'idée de l'urbanisme de projet, la loi "Duflot" sur la mobilisation du foncier de l'État en faveur du logement et le renforcement des obligations de production de logement social, la réforme de l'évaluation environnementale des documents d'urbanisme, deux études sur les schémas régionaux (SAR et Sraddt).
Dans la deuxième partie, l'ouvrage rend compte de l'évolution des textes officiels, de la jurisprudence, de la doctrine et de la pratique au cours de l'année écoulée au travers de treize chroniques thématiques traitant de l'aménagement du territoire, de la planification et des règles d'urbanisme, de la protection de la nature et de l'environnement, du patrimoine culturel immobilier, de la politique foncière, de la fiscalité et des participations, des opérations d'aménagement, des autorisations d'urbanisme, du contentieux, de l'habitat et de la politique de la ville, et de l'actualité de l'outre-mer.
Enfin, la troisième partie, consacrée aux droits de l'urbanisme étrangers, présente cette année les évolutions récentes intervenues en Grande-Bretagne, ainsi qu'une étude d'ensemble sur le droit de l'urbanisme en Turquie. Destiné aux juristes et aux professionnels de l'aménagement et de l'urbanisme, le DAUH 2013 constitue un outil précieux et opérationnel pour comprendre les mutations majeures des dernières années.

Les domaines d’exercice professionnel de l’architecture ou de l’urbanisme couvrent-ils encore l’ensemble des champs de compétence et de fonctionnalité nécessaires pour élaborer une vision synthétique et un modèle opératoire, qu’il soit local pour de grandes zones territoriales prises dans l’interaction dynamique de l’ensemble de la métropole en activité, ou global, supposant alors une relation privilégiée à un système de gouvernance unifié ? Que signifie aujourd’hui produire de l’urbain, élaborer un modèle de structuration urbaine ? Les grandes logiques identitaires de gestion, celles fondées sur la directivité, la coercition, la fonctionnalité et la représentation semblent désormais inopérantes. La notion même d’une planification qui construirait des schémas fixes de développement articulés sur une économie et sur un calendrier d’action, celle d’un encadrement rigide d’une croissance ou d’une réorganisation, paraît mise à mal par des logiques de développement hétérogènes, des économies spontanées plus à même de répondre à des demandes qualitatives sans cesse renouvelées.
Progressivement, la ville s’épanche et se recompose en un système ouvert, polynucléaire, qui phagocyte d’autres ensembles urbanisés jusqu’à former le domaine continu d’une conurbation, un territoire ouvert, sans identité, qui n’est plus déterminé par une frontière ou une limite. La question de la métropole, de la ville-source susceptible de rassembler et de fédérer une centralité de la décision, de la gouvernance, de rester le pôle de concentration et d’organisation des réseaux de circulation et d’information, et de regrouper les organes de la gestion économique, se heurte à des économies plurielles répondant à des demandes sociales, économiques, spatiales, ainsi qu’aux échelles de temporalité les plus hétérogènes.

La bulle foncière des années 1985-1990 a profondément modifié le visage de Tokyo. Une bonne partie du tissu pavillonnaire s’est brutalement verticalisé pour donner à la capitale nipponne l’allure d’une capitale mondiale. Pris dans la tourmente, les cimetières ont également connu des mutations, parfois même assez spectaculaires. Reste t-il une place pour les cimetières dans la capitale nipponne, considérant les fortes contraintes foncières auxquelles elle est soumise ? Le film "Mourir à Tokyo" témoigne de la résistance opiniâtre des espaces de la mort en dépit de l'explosion urbaine et des mutations, parfois radicales, qui les affectent. L'éclatement du modèle rural de la tombe familiale au profit de tombes individuelles a accru la demande d'emplacements funéraires, rendant ce marché très lucratif. Celui-ci fonctionne désormais selon des logiques très proches des marchés immobiliers, d'où l'intervention très remarquée des sociétés immobilières, en particulier dans deux domaines : l'aménagement de grands cimetières privés en banlieue et l'assistance technique auprès des communautés boudhiques pour l'aménagement de nouveaux espaces funéraires dans l'enceinte de leurs temples.

London grassroot groups are certainly making it clear what they need, from housing and transport to jobs and the environment. Is there a basic demand that underlies these needs? Is the idea of rights to the city a focus for that demand? This meeting explores the idea that Right to the City (RTTC) is a good focus for these needs and demands. It is called by individuals from UCL's Bartlett School of Planning, UCL's Urban Lab, the London-based international journal CITY, and the Just Space Network of London community groups. The meeting is the start of a potential series triggered partly by the talks given last autumn in London by Peter Marcuse, veteran lawyer, planning educator and activist in New York. It takes advantage of the presence in London of 2 activists who have been involved with the US RTTC movement and of the discussion advanced and continuing in CITY by Peter Marcuse and his colleagues. This meeting will be a series of short talks on the London issues, a short talk on the USA movement and then time for a substantial structured debate and discussion.</div>

New York is certainly the most populous and perhaps the most urban of America’s cities. Such qualities are not universally seen as representing positive attributes in a country in which the traditional city is regarded with a certain degree of political and popular suspicion and which is continually elaborating new forms of exurbia.<br />
<br />
Understanding New York’s very particular nature and its prospects is an essential part of coming to terms with the evolving nature of the contemporary city, as it faces up to the reality of the extraordinary size jump of the later years of the 20th century. Scores of cities now have populations far larger than entire European nations. A city with an effective population of 18 million people - now the size of both New York and London - is an entity with no historic precedent. If such a metropolitan area is to achieve the cohesion and the sense of identity that until now has been regarded as the fundamental essence of any successful city, then it must either learn from and build upon New York’s experiences, or else find an alternative workable model.<br />
<br />
As the first stage in a cumulative sequence of conferences organized by the Cities programme of the London School of Economics, with the support of the Alfred Herrhausen Society for International Dialogue, to be held in six cities across four continents, Urban Age is exploring the deliberately provocative proposition that New York is almost all right. Through a mix of muddle and dynamism, New York is succeeding as a city. It continually attracts new people, and creates new jobs for them.</div>

Can London cope with its future growth? Is it really Europe's only global city? What is the impact of massive regeneration projects?<br />

These are some of the questions that civic leaders, city-builders, architects and academics from around the world asked when they meet in London from 11 to 13 November 2005. The Mayors of Washington DC, Sao Paulo, Amsterdam, Barcelona and Edinburgh joined world-renowned urbanists Richard Rogers, Rem Koolhaas and Saskia Sassen to debate the future of a city facing momentous growth.</div>

Core themes included how quality of life can be maintained by promoting health; and city environments that work for people of different generations and incomes.<br />

Dans le cadre du projet "Mutual Heritage, from historical integration to contemporary active participation", un projet sur le patrimoine architectural et urbain récent dans le monde méditerranéen, une série de conférences est organisée en 2009-2010 par Laura Verdelli et Myriam Bacha, dans le but d'alimenter les questionnements posés par ce programme et encourager un échange avec les étudiants inscrits dans plusieurs disciplines des sciences humaines et sociales. Financé par l'Union européenne dans le cadre du programme Euromed Heritage IV, Mutual Heritage est un projet qui a pour objectif de développer des instruments et des compétences afin de faciliter l'intégration du patrimoine récent dans la vie quotidienne actuelle.<br />
<br />
Au regard du sur-investissement des acteurs publics et privés dans la fabrique des nouvelles périphéries du Caire depuis au moins trois décennies, le Caire est un cas d'étude de la marginalisation de son centre-ville "moderne" (initié par le khédive Ismaïl sur le modèle de Paris à partir des années 1870). Faute d’une attention de la part des décideurs, la montée des problèmes (hyper densité, pollution, congestion et dégradation des bâtiments historiques) conduit les autorités à vouloir délocaliser les fonctions stratégiques à l'extérieur.<br />
<br />
Pourtant, depuis le début des années 90, une dynamique de rupture par rapport à la marginalisation du centre khédivial semble s’esquisser à la lumière de deux actualités : le démarrage d’une nouvelle planification expérimentale de zones piétonnes aménagées de la fin des années 80 à la fin des années 90 dans le secteur de la bourse et dans les rues Shawarby et Alfy et le travail de lobbying mené par des intellectuels (écrivains, chercheurs, journalistes) et des artistes qui ont joué un rôle décisif surtout à partir de la fin des années 90. En lien direct avec un travail d’inventaire patrimonial, augurant d’une reconnaissance et d’une protection juridique par les autorités, le Caire khédivial bénéficie depuis peu d’un nouveau contexte d’action même si la volonté de relocaliser les activités stratégiques en périphérie demeure. Ministères, gouvernorat, nouvelle Agence nationale de l’harmonie urbaine ont impulsé en 2008 le lancement d’actions phares (réaménagement de la place Ramsès, requalification de la rue Ramsès et reconquête de la rue Qasr al-Nil). <br />

<div>Le Caire présente de multiples visages, de la vieille ville et du quartier "anglais", aux quartiers construits sans infrastructure, jusqu’aux "new settlements" et "cités-satellites". Retour sur les grandes étapes de l’urbanisation du Caire, avec Delphine Pagès-El Karoui.<br />
<br />
Au cours de l'émission, il sera question des fondations de la ville, du caire médieval, de la ville traditionnelle (1517-1798), du Caire contemporain, du tournant de 1963 qui voit la ville prendre, sous l'impulsion du souverain Isma'Il, un virage Hausmannien, puis de l'ère nouvelle, de la surdensification à l'effort de planification urbaine.<br />

<div><b>Présentation par l'éditeur :</b></div> </div> A la croisée de l'histoire et de l’histoire de l’art, cet ouvrage analyse, à travers le cas de Fès, l’ensemble des mécanismes de fabrication d’une ville nouvelle et ceux de son corollaire –  la transformation d’une ville ancienne  –, sous le Protectorat français au Maroc (1912-1956). Il met ainsi en lumière les distorsions entre l’idéal urbain, théorisé a posteriori par le résident général Louis-Hubert Lyautey et sa kyrielle de collaborateurs, et la réalité finalement sortie de terre.</div> <br /> Ce travail, basé sur des sources archivistiques dispersées de part et d’autre de la Méditerranée et dont certaines sont inédites, s’intéresse autant aux doctrines qui sous-tendent les transformations de la ville, aux protagonistes qui participent à ces changements, qu’au contexte dans lequel ils interviennent. L’auteur met ainsi en évidence qu’une ville nouvelle édifiée en contexte colonial est loin d’être la simple matérialisation d’une doctrine politique, ni une ville construite par et pour les Européens. Elle montre qu’au contraire, elle est l’oeuvre de tout un système d’acteurs pluriels –  administration, colons mais aussi élite locale  –, le résultat d’accointances, d’accords, de désaccords et surtout de compromis, autant qu’elle est le fruit des circonstances, de contingences géographiques, politiques, sociales ou encore économiques, et même de hasards.</div> </div> <b>Charlotte Jelidi</b> est historienne, chercheure à l'Institut de recherche sur le Maghreb contemporain (IRMC) de Tunis.</div> </div>
